Ces articles habilitent les municipalités locales à réglementer la délivrance des permis et des certificats en présence de contraintes naturelles. Le cadre normatif gouvernemental accompagnant les nouvelles cartes de zones exposées aux glissements de terrain est en effet conçu précisément de manière à mettre en œuvre des restrictions à la délivrance de permis ou de certificats en raison de certaines contraintes ». En effet, en vertu de ce cadre normatif, certaines interdictions s’appliquent en l’absence d’expertise pour assurer la sécurité du site. Principales caractéristiques L’article permet à une municipalité de prendre des mesures afin qu’aucun permis ou certificat ne puisse être délivré dans les parties de son territoire où l’occupation du sol est soumise à des contraintes naturelles sans une autorisation préalable du conseil. Si un tel règlement est en vigueur, le conseil prendra sa décision à la lumière de la recommandation d’un expert et du comité consultatif d’urbanisme. Cette décision pourra consister à refuser le permis ou à en accepter la délivrance sous certaines conditions afin d’assurer la sécurité des personnes et des biens. Seules les municipalités dotées d’un comité consultatif d’urbanisme peuvent donc adopter un tel règlement. La municipalité doit également désigner les parties de son territoire soumises à l’application des dispositions réglementaires relatives aux contraintes naturelles en vertu du paragraphe 16° du deuxième alinéa de l’article 113 ou du paragraphe 4° du deuxième alinéa de l’article 115 de la LAU. Seules des parties du territoire ayant été désignées peuvent faire l’objet d’une réglementation adoptée en vertu de l’article Le règlement doit préciser le type de contraintes appréhendées par exemple un risque de glissement de terrain. Il doit également déterminer le type d’expertises requises de la part du demandeur, ainsi qu’une description minimale de celles-ci, en fonction des contraintes applicables et du type de permis ou de certificat demandé. Le règlement pourrait exiger, par exemple, qu’une expertise géotechnique soit produite dans une partie du territoire sujette aux glissements de terrain. Il devrait exiger que cette expertise soit produite par un expert possédant certaines qualifications précises et qu’elle renseigne la municipalité sur la possibilité de donner suite à la demande de permis sans que cela présente de danger, compte tenu de la nature de la demande. Dans le cas où l’expert juge que le permis peut être délivré, le règlement devrait également exiger que cet expert fasse des recommandations sur les conditions qui devraient être imposées au demandeur s’il y a lieu, toujours dans le but d’assurer la sécurité du site. Ces conditions peuvent comporter l’exécution de travaux précis, réalisés au moyen de techniques propres à assurer cette sécurité. L’article ne permet pas de déroger à la réglementation applicable. La délivrance du permis doit être possible au départ, et seule la délivrance d’un permis accordé en vertu de cette réglementation est touchée par cet article. L’article ne sera donc d’aucune utilité dans une zone où l’on veut interdire certaines activités ou imposer une interdiction générale; cela devra être fait par le biais des pouvoirs normatifs habituels. Il en sera de même dans le cas où une municipalité doit prévoir une interdiction globale par exemple dans une zone à risque d’inondation de récurrence 0-20 ans pour se conformer aux dispositions du schéma d’aménagement et de développement qui concernent les zones à risque.
